NOTICE TO BIDDERS

PUBLIC NOTICE IS HEREBY GIVEN that sealed bids will be received by the BOROUGH OF SEASIDE PARK for the NJIB CLEAN WATER APPLICATION STORMWATER MAINTENANCE EQUIPMENT in BOROUGH OF SEASIDE PARK, OCEAN County, New Jersey.

Bid forms, contracts and specifications are available by contacting Remington & Vernick Engineers.  Contact shall be made by phone or by email to make bid purchase arrangements.  At 732-286-9220 or by submitting TR_RVEbidinterest@rve.com.

Said Bids will be received, opened and read aloud in public at the Borough Of Seaside Park, 1701 N OCEAN AVE, SEASIDE PARK 08752 on January 22, 2026 At 11:00 A.M.    

Electronic download link for copies of the bid forms, contracts and specifications may be obtained from said Remington and Vernick Engineers, by prospective bidders upon request, upon payment of the sum of $50.00 for each set.  Should interested bidders not have the ability to handle electronic download sets, a set may be arranged to be sent overnight by calling 732-286-9220. 

NO BIDS ARE TO BE PICKED UP AT THE ENGINEER’S OFFICE OR AT THE MUNICIPALITY OFFICES.

PAYMENT MUST BE RECEIVED PRIOR TO OBTAINING SAID SPECIFICATIONS.

NO BIDS ARE TO BE DROPPED OFF AT THE ENGINEER’S OFFICE.

ALL BIDS ARE TO BE DELIVERED PRIOR TO THE BID OPENING DATE AND TIME.

The scope of work for this project will consist of furnishing various pieces of equipment to be used for Stormwater Management to ensure clean water within the Borough of Seaside Park. Equipment purchase is to include a vacuum sewer cleaner truck, street sweeper, compact street sweeper and trailer mounted diesel generator.  The equipment shall be new, factory tested, and delivered to the Borough of Seaside Park, ready for use.  All equipment shall feature the manufacturer's standard warranty.

The BOROUGH OF SEASIDE PARK reserves the right to consider the bids for sixty (60) days after the receipt thereof, and further reserves the right to reject any or all bids, either in whole or in part and also to waive any informality in any and make such awards or take action as may be in compliance with the New Jersey Local Publics Contract Law N.J.S.A. 40A:11-1 et. Seq.

If indicated, bid proposals must be accompanied by a certified check, cashier's check, or bid bond in the amount of ten per centum (10%) of the total amount of the bid, but not in excess of twenty thousand ($20,000) dollars and made payable to the BOROUGH OF SEASIDE PARK.

The award of the contract shall be made subject to the necessary moneys to do the work being provided by the BOROUGH OF SEASIDE PARK in a lawful manner.  The contract to be executed by the successful bidder will provide that it shall not become effective until the necessary moneys to do the work have been provided by the BOROUGH OF SEASIDE PARK in a lawful manner.  The award shall further be subjected to the securing of necessary State, Federal or Local permits governing the work.

Bidders are required to comply with the requirements of  N.J.S.A. 10:5-31 et seq., N.J.A.C. 17:27 (Affirmative Action), N.J.S.A. 34:11-56.25 et seq.(New Jersey Prevailing Wage Act), and Americans with Disabilities Act of 1990 (42 U.S.C. S12101, et seq.).

The contractor is further notified that he must comply with N.J.S.A. 52:25-24.2 and submit a Disclosure Statement listing stockholders with his bid.

The contractor is further notified that he must comply with N.J.S.A. 34:11-56.48 et seq. Public Works Contractor Registration Act and he and any subcontractors must be registered in accordance with the act.

The contractor is also further notified that he must comply with N.J.S.A. 52:32-44 and submit proof of business registration and submit proof of business registration for any named subcontractors in accordance with the act.

This contract or subcontract is expected to be funded in part with funds from the New Jersey Department of Environmental Protection and the New Jersey Environmental Infrastructure Trust. Neither the State of New Jersey, the New Jersey Environmental Infrastructure Trust nor any of their departments, agencies or employees is, or will be, a party to this contract or subcontract or any lower tier contract or subcontract. This contract or subcontract is subject to the provisions of N.J.A.C. 7:22-3, 4, 5, 9 and 10.

This contract or subcontract is expected to be funded in part with funds from the New Jersey Department of Environmental Protection and the New Jersey Environmental Infrastructure Trust. Neither the State of New Jersey, the New Jersey Environmental Infrastructure Trust nor any of their departments, agencies or employees is, or will be, a party to this contract or subcontract or any lower tier contract or subcontract. This contract or subcontract is subject to the provisions of N.J.A.C. 7:22-3, 4, 5, 9 and 10.

The project is funded in part by the New Jersey Environmental Infrastructure Trust and the successful bidder must comply with all provisions of N.J.A.C. 7:22-9 et seq. for the participation of small business enterprises owned and controlled by socially and economically disadvantaged individuals (SEDs). This invitation to bid is on an unrestricted basis whereby the successful bidder must fulfill the SED utilization requirements. The agencies specified in N.J.A.C. 7:22-9.13(a)8 will have a list of eligible SED firms and shall, upon request, provide them to the MUNICIPAL CORPORATION. The MUNICIPAL CORPORATION, during the bidding phase, will provide copies of the list to all Contractors on unrestricted contracts.

Contractor shall be required to comply with the Project Plan developed by the Borough Of Seaside Park fulfilling the SED utilization. All prime Contractors will be required to submit a SED Utilization Plan to the Borough Of Seaside Park and the NJDEP Office of Equal Opportunity and Public Contract Assistance no later than thirty (30) days after notification that they are the low bidder. The Contractor shall award no less than ten (10) percent of the total amount of all contracts for building, materials, equipment or services for the project to SED’s.

Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27 (P.L. 1975, c.127, Affirmative Action); P.L. 1963. C150 (New Jersey Prevailing Wage Act); and Americans with Disabilities Act of 1990 (42 U.S.C. 12101, et.seq.).

Pursuant to N.J.A.C. 10:5-33, “Bidders are required to comply with the requirements of P.L. 1975, c. 127.”

The contractor is further notified that he must comply with P.L. 1977, c. 33, and submit a Disclosure Statement listing stockholders with his bid.

The contractor is further notified that he must comply with P.L. 1999 c.238 Public Works Contractor Registration Act and he and any subcontractors must be registered in accordance with the act.

The contractor is also further notified that he must comply with P.L. 2004 c. 57 and submit proof of business registration and submit proof of business registration for any named subcontractors in accordance with the act.

In accordance with N.J.A.C. 7:22-3.17(g) and N.J.A.C. 7:22-4.17(g), all applicable surety bonds required in connection with the advertisement and award of building contracts or sub-agreements must be written by a surety company listed on the Federal Treasury List (Department Circular 570-Surety Companies Acceptable on Federal Bonds), incorporated herein by reference. Copies of this document may be obtained from the United States Department of Treasury.
