NOTICE OF PUBLIC AUCTION OF REAL ESTATE LOCATED AT 66 I STREET, BLOCK 57, LOT 2 OF THE BOROUGH OF SEASIDE PARK, COUNTY OF OCEAN

PLEASE TAKE NOTICE that pursuant to N.J.S.A. 40A:12-13 et seq., the Borough of Seaside Park has authorized the sale of Block 57, Lot 2, via public auction. The property shall be sold at public auction via receipt of sealed bids which shall be received by the Borough Clerk no later than 10:00 am on August 14, 2023 and shall be opened and read on August 14, 2023 at 10:00 am at 1701 N Ocean Avenue, Seaside Park. Late bids will not be accepted.

The premises will be sold subject to Federal, State and Municipal Laws and Regulations including applicable ordinances, easements, conditions, restrictions, and rights of way of record and such facts as an a accurate survey may disclose. The Property to be sold is a vacant conforming lot without any capital improvements described as follows:

Block 57, Lot 2; 66 I Street, — Minimum Bid $586,000

 The successful bidder shall deposit either cash or a bank check, a deposit equal to ten (10%) percent of minimum price of the bid at time of bidding, with the balance to be paid by either cash or bank check at closing. The sale of the Property is being made subject to the terms, conditions, restrictions and limitations of a Contract of Sale, including but not limited to the following terms and conditions:

  1. The Property is being sold in an “AS IS” condition. The successful bidder is responsible for conducting any and all inspections and testing of the Property at its own cost and expense. The Property is sold subject to any and all conditions.
  2. The property shall not be used for any purpose other than single-family residential purposes. The term “residential purposes” excludes hospitals, clinics, duplex houses, apartment houses, boarding houses, hotel, commercial and professional uses. No building shall be erected, altered, placed or permitted to be constructed on this lot other than a single-family residential home constructed in accordance with Borough Ordinances.
  3. Should the Property be developed, it shall be done in accordance with all applicable Borough Ordinances, as well as County and State laws, rules and regulations.
  4. The deed must be recorded within thirty (30) days of closing or title to the Property shall automatically revert back to the Borough of Seaside Park without the necessity of entry or reentry.
  5. With respect to the sale of the Property herein, no real estate commission is owed.
  6. The deed given by the Borough of Seaside Park for the Property will be a Quit Claim Deed. No title contingencies or conditions are permitted.
  7. The Borough reserves the right to accept the highest responsive bid if equal to or greater than the minimum bid price, or to reject all and not to award to the highest bidder. The Borough reserves the right to waive any and all defects and informalities in any proposal, and to accept or reject the highest responsible and responsive bid deemed to be in the best interest of the Township.
  8. The sale shall be subject to other terms and conditions contained in a Contract for Sale of Real Estate, a form of which shall be forwarded to the purchases by the Borough Attorney. Failure to execute the Contract shall not affect the obligation of the successful bidder or the validity of the sale.
  9. The successful bidder shall pay an additional $550.00 which shall constitute the cost of preparation and Attorney’s review and approval of the documents, as well as the cost of recording the Deed with the Ocean County Clerk.
  10. The description and location of the land is for information purposes only, and prospective bidders should examine the Property prior to bidding to verify this information.
  11. Borough of Seaside Park shall not be responsible for the costs associated with any title/last owner or lien searches in the even the Borough of Seaside Park is unable to convey title and/or if a bid is rejected.

Bids must be on the bid form prepared by Remington & Vernick Engineers, in the manner designated therein and required by the specifications, must be enclosed in sealed envelopes bearing the name and address of the bidder on the outside and also bearing on the outside reference to the particular work bid upon. Said bids shall be addressed to Sandy Martin, Clerk, 1701 North Ocean Avenue, Seaside Park, NJ 08752.
 
Each bid shall be accompanied by a certified check, cashier’s check or bid bond duly executed by the bidder as principal and having as surety thereon a surety company approved by the Borough Of Seaside Park in an amount not less than ten percent (10%) but in no case in excess of $20,000.00 of the amount bid. Any such bid bond shall be without endorsement or conditions. Bid shall also be accompanied by a certificate letter from a surety company stating that it will provide the bidder with the completion bond.
 
The award of the contract shall be made subject to the necessary moneys to do the work being provided by the Borough Of Seaside Park in a lawful manner. The contract to be executed by the successful bidder will provide that it shall not become effective until the necessary moneys to do the work have been provided by the Borough Of Seaside Park in a lawful manner. The award shall further be subjected to the securing of necessary State, Federal or Local permits governing the work.
 
Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq., N.J.A.C. 17:27 (Affirmative Action), N.J.S.A. 34:11-56.25 et seq.(New Jersey Prevailing Wage Act), and Americans with Disabilities Act of 1990 (42 U.S.C. S12101, et seq.).
 
The contractor is further notified that he must comply with N.J.S.A. 52:25-24.2, and submit a Disclosure Statement listing stockholders with his bid.
 
The contractor is further notified that he must comply with N.J.S.A. 34:11-56.48 et seq. Public Works Contractor Registration Act and he and any subcontractors must be registered in accordance with the act.
 
The contractor is also further notified that he must comply with N.J.S.A. 52:32-44 and submit proof of business registration and submit proof of business registration for any named subcontractors in accordance with the act.

In general, the work to be performed under this project includes all necessary construction to provide a new, complete water treatment facility for the Borough of Seaside Park in Ocean County, New Jersey, as intended in the contract drawings and as required by the New Jersey Department of Environmental Protection (“NJDEP”), Bureau of Water System Engineering (“BWSE”).

A person bidding on a contract for the erection, alteration or repair of a public building, structure, facility or other improvement to real property, the total price of which exceeds $100,000, shall furnish a guarantee as provided for herein.  A contracting unit may provide that a person bidding on any other contract, advertised in accordance with law, shall furnish a guarantee as provided for herein.  The guarantee shall be payable to the contracting unit so that if the contract is awarded to the bidder, the bidder will enter into a contract thereof and will furnish any performance bond or other security required as a guarantee or indemnification.  The guarantee shall be in the amount of 5% of the bid, and may be given, at the option of the bidder, by certified check, cashier’s check or bid bond. Bid shall also be accompanied by a certificate letter from a surety company stating that it will provide the bidder with the completion bond.

The award of the contract shall be made subject to the necessary moneys to do the work being provided by the Borough Of Seaside Park  in a lawful manner.  The contract to be executed by the successful bidder will provide that it shall not become effective until the necessary moneys to do the work have been provided by the Borough Of Seaside Park  in a lawful manner.  The award shall further be subjected to the securing of necessary State, Federal or Local permits governing the work.

This contract or subcontract is expected to be funded in part with funds from the New Jersey Department of Environmental Protection and the New Jersey Environmental Infrastructure Trust. Neither the State of New Jersey, the New Jersey Environmental Infrastructure Trust nor any of their departments, agencies or employees is, or will be, a party to this contract or subcontract or any lower tier contract or subcontract. This contract or subcontract is subject to the provisions of N.J.A.C. 7:22-3, 4, 5, 9 and 10.

The project is funded in part by the New Jersey Environmental Infrastructure Trust and the successful bidder must comply with all provisions of N.J.A.C. 7:22-9 et seq. for the participation of small business enterprises owned and controlled by socially and economically disadvantaged individuals (SEDs). This invitation to bid is on an unrestricted basis whereby the successful bidder must fulfill the SED utilization requirements. The agencies specified in N.J.A.C. 7:22-9.13(a)8 will have a list of eligible SED firms and shall, upon request, provide them to the MUNICIPAL CORPORATION. The MUNICIPAL CORPORATION, during the bidding phase, will provide copies of the list to all Contractors on unrestricted contracts.

Contractor shall be required to comply with the Project Plan developed by the Borough Of Seaside Park  fulfilling the SED utilization. All prime Contractors will be required to submit a SED Utilization Plan to the Borough Of Seaside Park  and the NJDEP Office of Equal Opportunity and Public Contract Assistance no later than thirty (30) days after notification that they are the low bidder. The Contractor shall award no less than ten (10) percent of the total amount of all contracts for building, materials, equipment or services for the project to SED’s.

Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27 (P.L. 1975, c.127, Affirmative Action); P.L. 1963. C150 (New Jersey Prevailing Wage Act); and Americans with Disabilities Act of 1990 (42 U.S.C. 12101, et.seq.).

Pursuant to N.J.A.C. 10:5-33, “Bidders are required to comply with the requirements of P.L. 1975, c. 127.”

The contractor is further notified that he must comply with P.L. 1977, c. 33, and submit a Disclosure Statement listing stockholders with his bid.

The contractor is further notified that he must comply with P.L. 1999 c.238 Public Works Contractor Registration Act and he and any subcontractors must be registered in accordance with the act.

The contractor is also further notified that he must comply with P.L. 2004 c. 57 and submit proof of business registration and submit proof of business registration for any named subcontractors in accordance with the act.

The contractor is further notified that he must comply with N.J.S.A. 52:25-24.2, and submit a Disclosure Statement listing stockholders with his bid.

The contractor is further notified that he must comply with N.J.S.A. 34:11-56.48 et seq. Public Works Contractor Registration Act and he and any subcontractors must be registered in accordance with the act.

The contractor is also further notified that he must comply with N.J.S.A. 52:32-44 and submit proof of business registration and submit proof of business registration for any named subcontractors in accordance with the act.

Section 746 of Title VII of the Consolidated Appropriation Act of 2017 (Division A – Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations, Act, 2017) and subsequent statutes mandating domestic preference applies an American Iron and Steel requirement to this project. All iron and steel products used in this project must be produced in the United States. The term “iron and steel products” means the following products made primarily of iron or steel: lined or unlined pipes and fittings, manhole covers and other municipal castings, hydrants, tanks, flanges, pipe clamps, and restraints, valves, structural steel, reinforced precast concrete, and Construction Materials.

In accordance with N.J.A.C. 7:22-3.17(g) and N.J.A.C. 7:22-4.17(g), all applicable surety bonds required in connection with the advertisement and award of building contracts or sub-agreements must be written by a surety company listed on the Federal Treasury List (Department Circular 570-Surety Companies Acceptable on Federal Bonds), incorporated herein by reference. Copies of this document may be obtained from the United States Department of Treasury.

This procurement has been advertised in accordance with the “Fair and Open Basis” and nothing further shall be required under the Pay-to-Play Legislation (N.J.S.A. 19:44A-20.7).
